A nice story on how Elbert county overcame a big debt problem.
“In 2006, Elbert County was $2 million in debt. Tommy Lyon, the new chair of the county commissioners, and Bob Thomas, the new county administrator knew they needed to turn things around. Fast.
“We were having to borrow money to even operate,” Thomas said.
Entities like the volunteer fire department were skimping by with older equipment and stretched thin to cover the entire county. Things like paving roads had fallen by the wayside.
Desperate for a starting point, Lyon and Thomas looked just 35 miles down the road to the Carl Vinson Institute of Government at the University of Georgia.
“I quickly got to know the value of the Institute of Government,” Thomas said. “Being so close to Athens, I wanted to take full advantage of the educational resources available there…
The Institute of Government partners with local government associations, Association County Commissioners of Georgia (ACCG) and the Georgia Municipal Association for training for elected officials. Lyon and Thomas attended basic management courses required for all newly elected government leaders as well as numerous classes focusing on finances.
These classes were the key for Elbert County leaders to eradicate the massive debt. First, they took an in-depth look at their budget and learned the most effective ways to cut back on expenses. They found ways to harness the power of grants if they did not have funding for certain county needs. Leaders also learned to package certain projects and effectively communicate with their citizens, allowing them to raise ample amounts of SPLOST funding, the main source of funding for most of the county’s projects.
“The classes taught us to better utilize the resources we have, and how we can call on other resources if we don’t have the staff or people like the bigger communities,” he said. “The Institute of Government has been a top resource for us.”
Meadows points out that the leadership of Elbert County took full advantage of the offerings. “If you look at Elbert County’s training record, I would venture to say that between the city and county officials, they have one of the strongest training records of any group around the state,” she said.
With time and education, the county was able to get back on its feet and become self-sufficient, no longer relying on lines of credit to function. County staff didn’t get raises for five years, and if an expense wasn’t in the budget, it didn’t happen.
“We slowly but surely got ourselves out of the debt,” Thomas said.
New equipment, new roads and new potential
Since 2006, the county has built five new fire stations, purchased and outfitted six new fire trucks and begun more training for their volunteers. The stations no longer have to do fundraising to purchase new equipment; the county is able to self-fund all 12 fire stations.
The Insurance Services Office, Inc., provides a emergency services rating based on fire suppression capabilities of individual communities or fire protection areas. Because of the new buildings and equipment in Elbert County, all homes in the 370 square-mile county are within five road miles of a fire station, improving the county’s ISO rating from class 9 to class 4. This rating puts them in the top 20 percent of county fire services in Georgia.
For the homeowners of Elbert County, that rating means an estimated $2.5 million savings per year in insurance premiums. For incoming industries, it means a strong potential building site. ”

So I got a ticket for passing a school bus recently. The way this works now is that they have subcontracted out the collection of the fine. You get a notice in the mail encouraging you to pay the fine ($300). There is a web link that has photos and even video of the incident.

There is a deadline to pay by in a red box on the front of the form, and a small paragraph on the back explaining how to contest the fine, which says you will receive a second notice with a court date. But it is a bit ambiguous since it doesn’t say what happens if the ‘deadline’ passes and you haven’t gotten your court date. It turns out that deadline is pretty meaningless, just a motivator.

So then when you get your second notice with the court date, you are supposed to send in a stub on the form to confirm your hearing date. There apparently has been quite a bit of controversy about this. I won’t go into more detail here, but there is a lot more info at the links below.

FWIW, I plan to contest my ticket as the bus didn’t activate it’s signal until I was abreast of the bus and had no chance to stop in time. I think this company is being overzealous and deceptive in their attempts to collect these fines, and judges are throwing out a lot of these cases.

At the risk of politicizing this, I’m all for privatizing stuff when it makes sense, but sometimes these things shouldn’t be designed to be revenue generators for somebody. Traffic tickets, private prisons, private parole… they get paid on volume so it’s in their best interest to have more, which is often detrimental to us citizens.

Sounds weird, but I am much less worried about any private contractor abusing this kind of law than I am about prison or probation, which happens all the time. Because, e.g., w probation, the private entity has authority of law to issue an arrest warrant for alleged violations, in their discretion. With this, the citation comes from a bus camera, so then it’s about procedure. Abuses could happen if the citations or warnings or timelines weren’t followed, but those would all be easy to prove, and grounds for a judge to dismiss. The procedure is laid out fairly clearly in the law. The biggest window for abuse is the agent certifying that the photo demonstrates a violation, but I imagine any agent or officer might generally just rubber stamp this part of the process.
There might be many who are caught up like you, who then have to go to Court to fight that rubber stamping.
Just more data. It’s a big business.

I mean, it’s big business because a lot of ppl are passing school buses. Not a fan of over-policing or revenue schemes, but I do agree with the basis of this law. At least w the updated law, you don’t have to stop of you’re going the other way on a divided highway (including turn lanes). Probly a lot of folks got tickets that way.
Since I sometimes represent folks w traffic tickets, I went ahead and read the law. Glad you posted about it.
That 1st “deadline” is just for your 1st chance to contest the ticket. But as you note, the law gives you extra time to contest.
I haven’t seen an actual notice, so can’t say anything about that stub, but here is the relevant language of the law:
” The second citation shall include all information required in subparagraph (B) of paragraph (3) of this subsection for the initial citation and shall include a hearing date and time. If a person fails to appear on the date and time of such hearing set out in the second citation or if the person has failed to pay the penalty or file an appropriate document for rebuttal, the person issued the second citation shall have waived the right to contest the violation and shall be liable for the civil monetary penalty provided in paragraph (3) of this subsection.”
Does that stub count as a “document for rebuttal”? Maybe some are thinking it does, but it doesn’t make much sense. “Rebuttal” seems to be about evidence of theft, like a police report or affidavit as is apparent in the other part of the law.
So show up to the court date. You can win on your evidence or if he officer or “agent” doesn’t show to authenticate the photo. Being a new law, they may still be struggling with scheduling court appearances. You could also convince the prosecutor to reduce the fine- I mean civil penalty.
I am going to show up. The controversy with the stub is this: When you get a court date for a hearing, you normally don’t have to respond to “accept” that date. You show up, or if you don’t you can have a warrant issued against you I guess. And people are contesting this because they have never received a notice from the government about the court date, just some company letter. Supposedly it’s like being served a subpoena I guess; if you can avoid receiving it you don’t have to comply. So the scam is that by submitting the stub you are receiving the summons.

But that’s not my issue. I plan to go to court. But that stub says you have to mail it in within 14 days of the “issue date” on the form, which is problematic for a couple of reasons. That’s not enough time, and why should you have to respond anyway? The website above says you don’t have to and if you do it could compromise your defense. Also, the stub asks you to describe why you should not have been cited, which seems inappropriate to ask at this point.
So I was conflicted about sending in the stub, and probably ended up following the least beneficial path: I sent it in late and included my defense on the form. So we shall see.

The stub sounds more administrative than anything. If you can’t just show up and present your evidence then, then the procedure is faulty, and it won’t be long before some defense lawyers sue to get it right. At least in select Counties or Cities where the defense lawyers do that.

One other thing that might help all of you. Join the Federal Law Enforcement Officers Association as an associate member. You do not have to be former fed. They send you window stickers that show a badge. Cops who pull you over will all ask, ‘Who you with?” Now, I tell them the agency I used to be with and they almost always let me go. However, you folks can just say, “I joined FLEOA to show my support for you guys!” Dollars to Donuts, they’ll let you go, too! LOL!

There was a professor – Caroline Janney- who is starting at the Univ. of Virginia- who had the most historically-informed and nuanced perspectives on the issue of monuments. Her views will inform some of the decisions about some plaques on that campus, etc. But one nugget of her speech: The folks who made the monuments intended to “set into stone” their feelings. But feelings and experiences are never set in stone, as communities evolve.
